Immigration Message: Sheriff Miyamoto

The San Francisco Sheriff’s Office wants to reassure the public that we will not support any legislation that undermines San Francisco’s Sanctuary City Ordinance. Sheriff Miyamoto and the San Francisco Sheriff’s Office protect undocumented immigrants.

"My deputies cannot prevent ICE from enforcing immigration laws, but we will not tolerate a culture of fear and mistrust that undermines immigrants’ safety, freedoms, and rights, nor will we sit idly by as opportunistic criminals kill and profit off the fentanyl trade. Criminals victimize all of San Francisco, including our immigrant community. 

I understand that San Franciscans want a balanced approach- to welcome immigrants while ensuring that serious and violent criminals do not threaten the safety of our community. The federal government already knows the identity of every incarcerated person in our jails. If federal officials have a reason to arrest someone, they need a criminal warrant or court order.  

The Sheriff’s Office is not opposed to providing ICE with notice of an individual’s jail release date if that person meets very specific criteria regarding criminal history and current felony charges, and if they pose a public safety risk. Every case is thoroughly reviewed, and I make the final determination."

We support and comply with San Francisco’s Administrative Codes 12H & 12I, which affirm that San Francisco is a City and County of refuge. 

The Sheriff’s Office does not arrest people for civil immigration violations. We do not hold anyone over in jail if the court has ordered them released. Please watch the video for more information.
